These Terms and Conditions (“Terms”) form a binding agreement between you (“Customer,” “you”) and OnlySatvik LLC, a New Jersey limited liability company with its principal place of business in Fair Lawn, New Jersey (“OnlySatvik,” “we,” “us,” “our”). They govern your use of onlysatvik.com (the “Site”) and all food ordering, pickup, and delivery services offered through the Site (collectively, the “Services”).
1. Acceptance of Terms; Eligibility
By placing an order through the Site, you agree to these Terms. You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order. If you order on behalf of a business or organization, you represent that you have authority to bind it to these Terms.
2. Ordering, Prices, and Payment
2.1 Online ordering with full prepayment. All orders must be placed through the Site. 100% of the order total is due at checkout via the online payment methods offered (major credit and debit cards, processed securely by our third-party payment processor, Stripe). We do not accept cash, checks, or payment on delivery. An order is confirmed only after your payment is authorized; if authorization fails, no order is created.
2.2 Minimum order. A minimum order of $30 (before delivery fee and taxes) applies to all orders.
2.3 Advance notice. Orders must be placed in advance based on party size: 1–10 guests: at least 1 day; 11–25 guests: at least 2 days; 26–50 guests: at least 3 days; over 50 guests: at least 5 days.
2.4 Pricing errors. If a menu or pricing error is discovered, we may correct it before preparation begins. If the corrected price applies to your order, you may cancel for a full refund.
2.5 Order accuracy. You are responsible for reviewing your order before submitting it, including items, quantities, pickup/delivery selection, date, and time.
2.6 Changes after confirmation. Changes after an order is confirmed are limited. Change requests made within 24 hours of the scheduled pickup or delivery time may be declined and are not refundable or creditable.
2.7 Promotions are subject to their own terms and may not be combined unless stated.
2.8 Fraud and chargebacks. We may cancel and refund any order we reasonably suspect involves fraud, payment abuse, or a violation of these Terms. If you have a billing concern, please contact us first at info@onlysatvik.com so we can resolve it. We will dispute chargebacks we believe are unjustified using our order, delivery, and payment records.
3. Delivery and Pickup
3.1 Delivery area and fee. We deliver within a 10-mile radius of Fair Lawn, NJ. A flat $25 delivery fee applies and is shown at checkout. We may decline or cancel delivery orders outside our service area.
3.2 Delivery window. We target delivery within a 30-minute window around your requested time. Traffic, weather, and kitchen volume can cause delays; late delivery alone does not entitle you to a refund.
3.3 Inspect on arrival. Please check your order when it arrives. Issues must be reported while the driver is present — we cannot offer refunds for issues reported after the driver has left.
3.4 Delivery instructions (gate codes, floor, etc.) will be relayed to the driver but cannot be guaranteed.
3.5 Unavailable recipient. If no one is available to receive the order, it may be returned and you will still be charged in full.
3.6 Pickup. Please arrive on time for pickup. Late pickups are charged in full, and food quality may be affected by delay.
3.7 Food temperature may vary with delivery distance. Reheating is the customer’s responsibility.
4. Refunds and Cancellations
- We reserve the right to refuse service at our discretion.
- Service fee shown at checkout is non-refundable.
- Please inspect your order upon delivery or pickup. If there is an issue with your food, contact us immediately. We cannot offer refunds or discounts if 25% or more of the item has been eaten, or if the food has been discarded, altered, or repackaged.
- One replacement order per incident, at our discretion.
- Wrong items will be refunded to your original payment method; corrected items will be charged accordingly.
- Incomplete orders will be rectified; items we cannot prepare may be cancelled without penalty to you.
- We do not offer refunds based solely on taste preference.
- Once preparation of your order has begun, it cannot be cancelled, refunded, or credited.
- Cancellations before preparation begins: free if more than 24 hours before the scheduled pickup/delivery time; a 50% fee applies within 24 hours.
- No refunds on non-food items, beverages, or complimentary items. Disposable serving items are sold at extra cost and are not returnable.
5. Allergens and Dietary Information
Our food may contain or come into contact with peanuts, tree nuts, wheat, milk, sulfites, sesame seeds, and mustard seeds. We operate a shared kitchen, so we cannot guarantee any item is completely free of allergens. You must disclose allergies in the order notes or contact us before ordering, and confirm each item’s suitability for your dietary needs. Our food is vegetarian/satvik (no onion, no garlic) as described on the menu.
6. Food Safety and Handling
Our food is perishable. After receipt, refrigerate within 2 hours, consume the same day, and reheat to 165°F (74°C). We are not responsible for illness or spoilage resulting from improper storage, handling, or delayed consumption after pickup or delivery.
7. Limitation of Liability; Indemnification
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages arising from your use of our food, Services, or Site. Our total liability for any claim is limited to the amount you paid for the order at issue. The Services are provided “as is” and “as available,” without warranties of any kind, including merchantability, fitness for a particular purpose, or non-infringement.
You agree to indemnify, defend, and hold harmless OnlySatvik LLC and its members, officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Services, or information you provide to us (including undisclosed allergies).
8. Force Majeure
We are not liable for failure or delay caused by events beyond our reasonable control, including severe weather, power or internet outages, supply disruptions, government orders, or emergencies. We may cancel affected orders and issue refunds.
9. Changes to These Terms
We may update these Terms from time to time. Significant changes will be posted on the Site with a revised “Last Updated” date. Continued use of the Services after changes take effect constitutes acceptance.
10. Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law principles.
11. Dispute Resolution; Binding Arbitration Agreement
11.1 Informal resolution first. Before starting arbitration, contact us at info@onlysatvik.com describing the dispute. We will attempt to resolve it informally for 30 days.
11.2 Binding arbitration. Any dispute not resolved informally will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitration will take place in Bergen County, New Jersey, or by video/phone if both parties agree.
11.3 Small-claims carveout. Either party may instead bring a qualifying claim in small-claims court in Bergen County, NJ.
11.4 Class-action waiver. All proceedings will be conducted on an individual basis only. You waive the right to participate in any class, collective, or representative action, and waive the right to a jury trial.
11.5 Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing info@onlysatvik.com with the subject line “Arbitration Opt-Out” and including your name and the email address used for your order.
11.6 Fees. AAA’s Consumer Arbitration Rules on filing and arbitrator fees apply.
